As discussed in depth in a previous Journal article, the United States Supreme Court had before it this term a case that concerned the role of a physician in a managed care group health plan under the Employee Retirement Income Security Act of 1974 (?ERISA?). The primary issue in the case was whether treatment decisions made by HMO physician employees were fiduciary acts under ERISA.
